Membership Terms & Conditions

Spa and Leisure at Portavadie Terms and Conditions of  Membership

  

 

 

Members of Spa and Leisure at Portavadie are bound as a condition of their membership to comply with the regulations of the membership terms and conditions.  These have been drawn up to ensure that all Members, and Guests, are assured of an enjoyable and safe visit. Should you have any questions regarding any part of this documentation please raise these with a member of the Spa and Leisure management team.

Before committing to membership you should carefully read the Membership terms and conditions.

 

1. About this Agreement

    1. Definitions

Spa and Leisure at Portavadie;, ‘us’, ‘we’, ‘our’, ‘Manager’, ‘Management’,.

You the member; ‘Member’, ‘Members’, ‘you’, ‘their’.

 

1.2 The “Agreement” means the membership entered in by you and us which incorporates the application form, the pre activity questionnaire, the terms and conditions and membership rules.

 

2. Acceptance as a member

2.1 Acceptance as a member of Spa and Leisure at Portavadie is at the sole discretion of the management.  Your membership will commence on the date of acceptance as a member.

2.2 Upon acceptance, the member will be issued with an individual member identification band, which must be produced on each visit to gain entrance and worn while using the facilities. The membership identification band remains the property of Portavadie and if lost a nominal replacement fee will be charged to replace the band. The identification band must be surrendered upon cessation of the membership.

 

3. Membership

3.1 There are different Membership Payment Plans available as set out below

3.1.1 “Annual Payment” this is annual payment where membership payments are paid in full at the beginning of the contract term. A joining fee and administration fee may be payable.

3.1.2 “Annual Direct Debit” this is an annual membership where payments are paid monthly by Direct Debit from your bank account. A joining fee and administration fee may be payable.

3.2 There are different Membership Categories available as set out below

3.2.1 An “Individual Membership” applies solely to the individual and is not transferable. A joining fee and administration fee may be payable.

3.2.2 A “Joint membership” applies to married couples, partners or friends residing at the same address. One of the Joint Members will become the Primary Member and be responsible for all joining, administration and membership fees for the Joint Membership. Direct Debit collections will only be taken from the Primary Members account. A joining fee and administration fee may be payable.

3.3.3 A “Family Membership” applies to two adults and up to three children under the age of 16 residing at the same address. A joining fee and administration fee may be payable.

3.3.4 A “Cub Membership” applies to a child between the ages of birth and four years and will be entitled to have free membership up to the age of four. Upon reaching their fourth birthday they will automatically become a “Cadet” and pay the current “Cadet” membership fee. “Cub” members are not permitted to use the Gym, Sauna, Steam room, Outdoor spa pools and second floor Spa Experiences. All “Cub” members must be accompanied by an adult (over the age of eighteen) member at all times and within the specified hours.

3.3.5 A “Cadet Membership” applies to a child between the ages of four years and fifteen years. “Cadet” members are not permitted to use the Gym, Sauna, Steam room and first floor Spa Experiences. Upon reaching their sixteenth birthday they will automatically become a “Collegiate” member and pay the current “Collegiate” membership fee. All “Cadet” members must be accompanied by an adult member (over the age of eighteen) at all times within the specified hours.

3.3.6 A “Collegiate Membership” applies to a young adult between the ages of sixteen and eighteen. Upon reaching their eighteenth birthday they will automatically become a “Full Individual” member and pay the current Full Individual membership rates.

3.3.7 A “Spa Membership” will have full use of the Leisure facilities including the Spa Experiences on the first floor. All “Spa Members” must be over the age of 18 and spa treatments are not included.

3.3.8 Any Joining Fee is payable on acceptance of the Membership application form and is non-refundable.

3.3.9 Monthly subscription fees are payable by Direct Debit. No other method of payment will be accepted (subject to variation by management).  Direct Debits will be processed on the 1st working day of each calendar month.  A minimum of 12 full payments are required to honour the membership term (see point 4)

3.3.10 We reserve the right to vary the subscription fees from time to time.  Members will receive one calendar month’s notice of any such changes.

 

4. Membership Contract Term

4.1 For Annual payment memberships the contract will be 12 months. To renew your annual membership you must do so no later than 14 days before the end of your current membership term in accordance with the terms and conditions of the contract.

4.2 For Annual Direct Debit payment memberships the initial contract will be no less than 12 months. Thereafter Membership will continue indefinitely on a monthly basis at the prevailing rate in accordance with the terms and conditions of the contract. A minimum three month notice period must be served to terminate your membership at the end of month twelve. After completion of the initial membership term, your membership may be terminated by you giving one calendar months’ notice in writing via e-mail or registered post. 
4.2.1 In the event that you fall into arrears in respect of any fees payable, without prejudice we reserve the right to suspend all membership until all arrears have been cleared. We will take legal action to recover the funds outstanding plus any costs incurred in pursuing the arrears.

 

5. Cancellation of Membership

5.1. Membership cancellation notice for all memberships must be communicated via e-mail or registered post to the Spa and Leisure Manager directly.

5.2 During the first initial 12 month term of membership you are unable to cancel your membership other than due to genuine and relevant medical reasons (supporting professional documentation must be supplied)

 

6. Termination of Membership

6.1 We reserves the right to refuse admission and suspend any member forthwith if any member shall, in the opinion of management cause nuisance or annoyance to other Members or Guests; and for any breach of the  rules or misuse of facilities, or for any other reason management may feel appropriate.

6.1.1 If we do terminate your membership for any of these reasons you shall not
be entitled to any repayment.

6.1.2 Any member whose membership is suspended may not use Spa and Leisure as a guest.

 

7. Membership Holiday

7.1 Members may apply for a temporary suspension of their membership for a period of no less than 3 months and a maximum of six months in any twelve month period from commencement of membership, for reasons of ill health, pregnancy, temporary work assignment away from the area or redundancy.  Suspension is at the sole discretion of the management and an administration fee of £10 will be levied per member per calendar month.  The duration of suspension will be added to the membership term in accordance with point 4.  Proof of reason to suspend will be requested.  This will normally be a doctor’s or employer’s letter.

 

8. Children

8.1 Children under the age of sixteen are not allowed to enter the Spa.

8.2 Young Adults aged sixteen and seventeen must be accompanied by an responsible adult over the age of eighteen years while using the spa facilities.

8.3 Children under the age of sixteen must be accompanied at all times by a responsible adult over the age of eighteen when using the leisure facilities.  Children under the age of sixteen may not use the Gym. 

8.4 Sixteen and seventeen year olds must have prior written permission from a parent or guardian to use the Gym and have completed an induction programme with a member of our staff. 

8.5 Children under the age of 16 must be supervised by a responsible adult over the age of 18 when using the pool facilities.

8.6 One adult may supervise up to two children under the age of four years who must be wearing a BSI approved buoyancy aid.

8.6.1 One adult may supervise up to two children between the ages of four years and 7 years with or without a BSI approved buoyancy aid.

8.6.2 One adult may supervise up to 3 children aged four and seven years if one child holds an ISRM award or equivalent.

8.6.3 One adult may supervise one child under the age of four and one child under the age of seven providing the younger child is wearing BSI approved armbands.

8.7 One adult can enter the leisure facilities with up to a maximum of three children under the age of sixteen
8.8 Children under the age of sixteen are not permitted under Health and Safety recommendations to use the Sauna.

8.9 Children under the age of eight are not permitted to use the outdoor spa pools.

 

9. Repairs and Maintenance

9.1 We reserve the right to close areas of the club to carry out planned maintenance repairs or refurbishment whether routine or extraordinary in nature. We will always attempt to minimise any disruption.

 

10. Use of Facilities

10.1 A member is entitled to use the facilities available under the relevant category of membership. We reserve the right to add or change the facilities for any period and with or without notice in connection with any cleaning, repair, alteration or maintenance work or any other reason which Management deems necessary.

10.2 We reserve the right at anytime and without notice to set aside facilities for exhibitions or other social events and activities.

10.3 We reserve the right to alter opening and closing times seasonally with or without prior notice.

10.4 A member may bring up to 3 paying guests in any one visit.

 

11. Facility Access

11.1 We reserve the right to restrict or delay access at such times when the number of users reaches maximum capacity within Health and Safety guidelines.

11.2 We reserve the right to refuse access to any member where this is suspicion of being under the influence of alcohol or drugs.

 

12. Fitness Activities

12.1 A fitness induction and pre-activity readiness questionnaire must be completed before access to the Facilities.  Any positive response to the pre-activity questionnaire will result in non-admittance to the Fitness Facilities until written permission from your GP is obtained.

12.2 Members are advised not to undertake strenuous physical activities from which they might be medically unfit.

12.3 Members who have any reservation as to their physical condition must have written permission from their GP prior to embarking in any exercise.

12.4 All members must sign a disclaimer prior to using the Fitness Facilities.

 

13. Swimming Pools

13.1 For reasons of health and safety, members are asked to abide by the following: no running, jumping, or diving is allowed in or around the pool areas. All bathers must shower prior to entering the pool.  Members with verruca’s athlete’s foot or other similar communicable maladies are requested not to use the pool.

13.2 The use of inflatable toys and beds are subject to management approval.  Any such toys believed, at management’s discretion, to be detrimental to the pool and its users will not be permitted.

13.3 The pool may be reserved at certain times for swimming lessons or other group activities.  Prior notices will be displayed and communicated through social media channels.

 

14. Dress Code

14.1 Correct footwear and attire must be worn when using the fitness facilities. Branded football strips are not permitted anywhere in Spa and Leisure at Portavadie.  Appropriate swim wear must be worn when using the pool and heat experiences. 

 

15. Lockers

15.1 Lockers are provided for Members to use during their visit.  All items are left at the owners risk and the Management accepts no responsibility for items left in the lockers and changing facilities.  Lockers are emptied each night and any charges associated with the return of the items will be met by the member.

 

16. Safety and Hygiene

16.1 In the interests of safety and hygiene, no crockery or glassware are allowed in the changing rooms, fitness areas, heat experiences or poolside. No pets will be allowed with the exception of guide dogs.  Entry to the facilities is only permitted at the designated entrance.

 

Fire Exits which are clearly marked are there in the interests of safety and members must not interfere with these doors for any reason. In the event of a fire members are asked to make their way in an orderly fashion to the nearest fire exit and muster at the designated assembly point.

 

17. Lost Property

17.1 All lost property found on the premises should be handed in to Spa and Leisure reception.  Enquiries for claiming lost property, should be made at the reception desk .Please note Items handed in will be stored for a maximum four weeks.

 

18. Liability

18.1 Management liability for damage or loss to members’ or guests’ property is strictly limited to any damage or loss suffered as a result of negligence of Portavadie , its staff or its agents.

18.2 Management will not accept liability for money, valuables or any personal property of members unless such property is handed in to the reception and a signed receipt is issued.

18.3 Management reserves the right, in its absolute discretion, to refuse to store any such property of members.  Property stored in lockers provided by Portavadie or its agents is stored at the owners risk and no liability for loss or damage there to will be accepted by management.

18.4 Management cannot accept any liability for any accident to any members or guest that may occur on the premises or within the grounds other than liability which may arise from negligence of Portavadie, its staff or its agents.

18.5 Any member who suffers an accident on the premises or Portavadie grounds must report this accident, and the circumstances, under which it occurred, to the management immediately following the accident.

 

19. General

19.1 No food or drink, alcoholic or otherwise purchased outwith, may be brought into and consumed in Spa and Leisure at Portavadie or its grounds.

19.2 Members, who fail to take up a booked activity, or fail to give the required notice, will be liable for an administration charge together with the activity cost if applicable.  Further details of the level of these fees are available from reception and may vary from time to time at the sole discretion of the management.

19.3 All Members are asked to observe the rules, a copy of this of which is located at Leisure Reception.  Members must comply with any reasonable directions which the Management may give to ensure the smooth operation of the facilities and the convenience and safety of all members and guests.

19.4 The Spa and Leisure Manager, whose decision shall be final, shall determine any dispute or difference, which may arise with regard to the interpretation of these rules.

19.5 Management reserves the right to amend these rules and all tariff charges, at any time and without notice to individual members.

19.6 If any provision in these rules is declared illegal or otherwise unenforceable, the remaining provisions shall remain in full force and effect.

19.7 You must write to inform us of any change to your personal details you have provided to us. If you fail to notify us of a change of postal or e-mail address, any communication we be deemed to have been received by you five days after sending by us.

19.9 In the event of any disagreement in the interpretation of the Terms and Conditions of Membership Rules the management decision is final.

19.10 A person who is not party to this agreement has no right under the Contracts Act 1999 to enforce any term of this Agreement but this does not affect any right to remedy of a third party which exists subject to the provision herein.

19.11 This agreement shall be governed shall be by and constructed by Scottish Law and the parties agree to submit to the exclusive jurisdiction of the Scottish courts.

 

20. Data Protection

20.1 Personal information that you provide to us in connection with your membership is held subject to and in accordance with the Data Protection Act 1998.  This Act regulates the use of personal data and gives you various rights relating to the maintenance and use of that personal data.

20.2 Subject to us receiving contrary notice from you as explained below, we may use the information you provide within an application form for the purposes of providing details of any products and services which may be of interest to you either by post, telephone or email for general business purposes or marketing.

20.3 Should you wish us to cease using your personal information for the above purposes you have the right to notify us at any time.  Once we have been notified we will comply with your request as soon as possible and cease using the information no later than one calendar month from receipt of your notification.

 

21. Variation of terms

 We reserve the right to vary these terms and conditions, including the rules at any time to reflect changes in connection with the management and operation. Unless the changes are due to health and safety reasons or essential to safeguard our interests and those of our members.  We will use reasonable efforts to give you 10 days’ notice before any change takes effect.

 

22. Your Obligations

22.1 You agree to pay any and all fees, subscriptions and all other applicable charges.

22.2 To comply with the Management Rules.

22.3 To observe in particular all health and safety rules regarding the usage of the facilities.

22.4 To use the Spa and Leisure equipment and facilities in accordance with all the usage instructions.

22.5 To utilise your member account you must be in suitable credit to cover any purchased goods and services.

 

23. Opening Hours
23.1 The opening hours of the facilities will be published on the Portavadie website. These times may vary at Christmas, New Year and official holidays.  Members will be notified of any changes to the opening hours in advance, through appropriate means of communication.
